This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name www.parkbuzz.in, including the related mobile site and mobile application.

The Platform is owned and operated by Toupto Technologies Private Limited, a company incorporated under the Companies Act, 1956, with its registered office at A-407, Ganesh Glory 11, Jagatpur Road, Gota, Ahmedabad-382470.

Your use of the Platform, services, and tools are governed by the following terms and conditions as applicable to the Platform, including the applicable policies, which are incorporated herein by way of reference. If you transact on the Platform, you will also be subject to the policies that are applicable for such transactions. By merely using the Platform, you shall be contracting with the Platform Owner, and these Terms of Use, including the policies, constitute your binding obligations with the Platform Owner.

These Terms of Use relate to your use of our website, mobile application, and services, including but not limited to vehicle parking management, visitor parking solutions, valet services, parking ticket issuance, QR code-based entry, and payment processing.

Any terms and conditions proposed by you which are in addition to, or which conflict with, these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

For the purposes of these Terms of Use, wherever the context so requires, “you”, “your”, or “user” shall mean any natural or legal person who has agreed to become a user/buyer of the Services on the Platform.

ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THEM CAREFULLY BEFORE PROCEEDING.

 

 

1. User Obligations

  • You agree to provide true, accurate, and complete information to us during and after registration, including your name, contact number, and vehicle number plate, and you shall be responsible for all acts done through the use of your registered account on the Platform.

  • You are solely responsible for ensuring that your Global Parking Ticket, QR code, or other parking credentials issued via the Platform are kept secure and not shared without authorization.

 

 

2. Payments & Fees

  • The Platform enables you to make payments for Services via integrated third-party payment gateways (such as Razorpay/Paytm/Stripe/others, as made available on the Platform). By using the payment gateway, you agree to be bound by the terms and conditions, privacy policy, and other applicable policies of the respective payment gateway service providers.

  • You agree to pay the applicable parking charges, booking charges, convenience fees, and/or any other applicable amounts displayed on the Platform at the time of booking or availing of the Services.

  • All payments shall be made in Indian Rupees (INR) unless expressly stated otherwise.

  • Advance payments made for parking or events are non-transferable and may be subject to event-specific refund or cancellation policies. Refunds, if any, will be processed as per the refund policy displayed at the time of transaction, and the timeline for credit shall depend on the payment gateway and issuing bank.

  • We do not store your debit/credit card details, UPI PINs, or any sensitive payment information. All transactions are processed securely by the respective payment gateways.

 

 

3. No Warranty

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on this Platform or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of our Services and the Platform is solely and entirely at your own risk and discretion, for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.



4. Intellectual Property

The contents of the Platform and the Services are proprietary to us and/or licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents include, but are not limited to, the design, layout, look, and graphics. Unauthorized use of these materials may lead to legal action.

 

5. Prohibited Use

You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal, or forbidden by these Terms, or by Indian or local laws that might apply to you.

 

6. Third-Party Links

The Platform and Services may contain links to other third-party websites. Upon accessing these links, you will be governed by the terms of use, privacy policy, and other applicable policies of such third-party websites. These links are provided solely for your convenience.



7. Legal Relationship

By initiating a parking booking, payment transaction, or ticket generation through the Platform, you are entering into a legally binding and enforceable contract with the Platform Owner for the Services.



8. Indemnity

You shall indemnify and hold harmless the Platform Owner, its affiliates, and their respective officers, directors, agents, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising from your breach of these Terms of Use, the Privacy Policy, other policies, or your violation of any law or rights of a third party.



9. Limitation of Liability

In no event will the Platform Owner be liable for any indirect, consequential, incidental, special, or punitive damages, including without limitation loss of profits, revenues, business interruption, or loss of data. Our total liability to you shall not exceed the amount paid by you for using the Services giving rise to the cause of action, or Rupees One Hundred (Rs. 100), whichever is less.



10. Force Majeure

The Platform Owner shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, strikes, internet outages, or government restrictions.



11. Governing Law & Jurisdiction

These Terms and any dispute or claim relating to them shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
